c) Products: the services offered through the Visit Sogliano al Rubicone
mobile application d) User: the person who accesses the Visit Sogliano al Rubicon mobile application, without distinction of legal nature and purpose pursued;
e) Consumer: natural person who acts for purposes unrelated to any commercial, artisanal or professional entrepreneurial activity carried out;
f) Conditions: this contract that governs the relations between the Owner and the Users.
– Industrial and Intellectual Property
RightsThe Data Controller declares to be the owner and/or licensee of all intellectual property rights relating to and/or relating to the Visit Sogliano al Rubicone mobile device application and/or the materials and content available on the Visit Sogliano al Rubicon mobile device application. These Terms do not grant the User any license to use the Visit Sogliano al Rubicone mobile application and/or individual Content and/or materials available therein, unless otherwise regulated. The contents are edited by the Municipality of Sogliano al Rubicone and by the ATI (Temporary Business Association) made up of Coop Sociale La Finestra, Akamai by Irene Marini and GrooveUp by Cola Leonardo.
– Content editing
The information content of the site is collected and processed by the editorial staff VisitSoglianoalRubicone.it on the basis of information received from the public and private bodies of reference for the places and activities presented. Some content has been directly provided by third parties responsible for the places and services presented on the site, others have been taken from publications and/or writings of which the sources are cited.
– Reporting incomplete or incorrect information, requests for updates, suggestions. Limitation of liability
The Municipality of Sogliano al Rubicone has the right to modify the contents and operating methods of the Visit Sogliano al Rubicon mobile application at any time and at its own discretion. The Visit Sogliano al Rubicone mobile application is a public utility service. The Municipality of Sogliano al Rubicone allows links to the Visit Sogliano al Rubicone mobile application on both public and for-profit websites. Any links must adhere to the following guidelines:

–Limitation of Liability
The Data Controller may not be held liable to the User, except in the case of wilful misconduct or gross negligence, for inefficiencies or malfunctions related to the use of the internet network outside its control or that of its sub-suppliers. The Owner will also not be liable for damages, losses and costs suffered by the User as a result of the non-performance of the contract for reasons not attributable to him, as the User is only entitled to a full refund of the price paid and any ancillary charges incurred. The Account Holder assumes no responsibility for any fraudulent and illicit use that may be made by third parties of credit cards, cheques and other means of payment, at the time of payment for the services purchased, if it demonstrates that it has taken all possible precautions based on the best science and experience of the moment and on the basis of ordinary diligence. The User undertakes to indemnify and hold harmless the Owner (as well as any subsidiaries or affiliates thereof, its representatives, collaborators, consultants, administrators, agents, licensees, partners and employees), from any obligation or liability, including any legal fees incurred to defend itself in court, that may arise in the face of damage caused to other Users or third parties, in connection with any Content you upload or your violation of the terms of law or the terms of these Terms. Therefore, the Data Controller shall not be liable for:
a) any losses that are not a direct consequence of the breach of contract by the Data Controller;
b) any loss of commercial opportunity and any other loss, even indirect, that may be suffered by the User (such as, but not limited to, commercial losses, loss of revenues, income, profits or presumed savings, loss of contracts or business relationships, loss of reputation or goodwill, etc.)
c) incorrect or unsuitable use of the mobile app by Users or third parties;
d) the issuance of incorrect tax documents due to errors relating to the data provided by the User, the latter being solely responsible for the correct entry.
Under no circumstances may the Owner be held liable for a sum greater than twice the cost paid by the User.
–Renunciation
No waiver by either party of any provision of these Terms shall be effective unless expressly stated to be a waiver and is communicated in writing.
– Invalidity of individual clauses
If any provision of these Terms is found to be illegal or invalid, it will not be deemed to form part of the Terms and this will not affect the remaining provisions which will continue to be valid to the fullest extent permitted by law.
–Privacy
The protection and processing of personal data will take place in accordance with the Privacy Policy, which can be consulted in the Privacy Policy section.
–Applicable law and jurisdiction
These Terms and all disputes regarding execution, interpretation and validity are subject to Italian law and the exclusive jurisdiction of the court of the place where the Data Controller is located. If the User is a consumer pursuant to Article 3 of the Consumer Code, the mandatory territorial jurisdiction lies with the court of the place of residence or domicile of the consumer, if located in the territory of the Italian State, without prejudice to the right for the User-consumer to bring an action before a court other than that of the “consumer’s court” pursuant to Article 66 bis of the Consumer Code, jurisdiction for the territory according to one of the criteria referred to in art. 18, 19 and 20 of the Code of Civil Procedure.

dispute resolutionFor consumers The Consumer residing in Europe should be aware that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the Consumer to resolve in a non-judicial way any dispute relating to and/or deriving from contracts for the sale of goods and services stipulated online. Consequently, the Consumer can use this platform for the resolution of any dispute arising from the online contract entered into with the Owner. LEGAL
These Terms of Use apply to any user who uses the services on the mobile app.
Liability and guarantees.
The user guarantees that any content inserted or communicated through the Site does not violate the law, does not infringe copyrights, patents, trademarks or distinctive signs, and any other rights of third parties. You are solely responsible for any infringement of these rights.
The Municipality of Sogliano al Rubicone will not be responsible in any way for any damage or prejudice that users may suffer from accessing, interconnecting, downloading material and computer programs from the mobile app.
Therefore, the Municipality of Sogliano al Rubicone will not be liable for any damages, losses, prejudices of any kind that third parties may suffer due to contact with the mobile app, or following the use of what is published in it as well as the software used.
Copyright
Any material contained on the Visit Sogliano al Rubicon mobile application, including graphic layout and software, is protected under copyright laws and intellectual property protection regulations.
The images, texts and trademarks on this site are the property of the Municipality of Sogliano al Rubicone.
The Municipality of Sogliano al Rubicone permits the use of data, photographs or documents contained in this site on condition that:
a) each copy contains the mention “Copyright Visit Sogliano al Rubicone”.
b) no document is modified: any alterations may incur serious civil and criminal penalties in accordance with copyright law.

Purposes of the Processing
Personal data are processed exclusively for the purposes that fall within the institutional tasks of the Administration or for the fulfilments required by laws or regulations.
